Introduction & Acceptance

These Terms of Service ("Terms") constitute a binding agreement between you and Astittva ("Company," "we," "us," "our"). By accessing, browsing, or using the Astittva website and/or mobile application (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service following modifications constitutes your acceptance of the updated Terms.

1. User Eligibility & Account Responsibilities

A. Eligibility

  • You must be at least 18 years old to use this Service
  • Users aged 13-18 require parental or guardian consent
  • You must be a resident of a jurisdiction where our Service is legally available
  • You must not be prohibited by law from using the Service

B. Account Registration & Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate, truthful, and complete information during registration
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access or suspicious activity
  • We are not liable for unauthorized use of your account due to your negligence

C. Account Termination

You may delete your account at any time through your account settings. We may terminate your account if you violate these Terms or applicable laws. Upon termination, your access to the Service ceases immediately.

ASTITTVA PROVIDES ASTROLOGICAL GUIDANCE ONLY. THE SERVICE IS FOR ENTERTAINMENT AND EDUCATIONAL PURPOSES ONLY.

  • Astrological predictions are NOT guaranteed and cannot be relied upon for major life decisions
  • Astittva AI is NOT a substitute for professional medical, legal, financial, or mental health advice
  • Do not use our Service to diagnose, treat, or manage medical or psychological conditions
  • Always consult qualified professionals (doctors, lawyers, therapists, financial advisors) for important matters
  • We do not provide personalized investment, medical, legal, or therapeutic services

Service Components:

  • AI Astrological Chat: Conversational guidance based on Vedic astrology principles
  • Birth Chart Analysis: Astrological interpretation of your birth data
  • Personalized Readings: AI-generated astrological insights (not guaranteed accurate)
  • Cosmic Shop: Sales of gemstones, spiritual products (sold as-is, subject to product terms)
  • Consultations: Optional paid sessions with astrology experts (availability varies)

3. User Conduct & Prohibited Activities

You agree NOT to:

Violate Laws: Use the Service to violate any laws or regulations

Harassment: Engage in threatening, abusive, or harassing behavior

Fraud: Provide false information, impersonate others, or commit fraud

Intellectual Property: Copy, modify, or redistribute Service content without permission

Spam: Send unsolicited messages or spam

Bots/Scrapers: Use automated tools to scrape or collect data

Adult Content: Share sexually explicit, violent, or illegal content

Misuse AI: Use AI for generating harmful, discriminatory, or illegal content

We reserve the right to suspend or terminate your account for violations without refund.

4. Payment & Refund Policy

A. Payment Terms

  • All prices are in Indian Rupees (₹) unless otherwise stated
  • Prices may include applicable taxes (GST where required)
  • Payment is processed securely through Razorpay, Stripe, or similar providers
  • You are responsible for all payment-related charges and currency conversion fees
  • We reserve the right to modify prices with 30 days' notice

B. Subscription & Billing

  • Subscriptions renew automatically on the billing date
  • You can cancel anytime through your account settings
  • Cancellation takes effect at the end of the billing period
  • No refund for partial billing periods unless legally required

C. Refund Policy

  • Digital Products/Services: No refund after access/delivery (as per consumer law exemptions)
  • Physical Products: 7-day return window from delivery for defective items
  • Consulting Sessions: Refunds available if session cancelled 48 hours before booking
  • Complaints: Refund requests must be filed within 30 days of purchase
  • Exceptions: Refunds may be granted at our sole discretion for service failures

5. Intellectual Property Rights

A. Our Intellectual Property

All content, design, text, graphics, software, and other materials on the Service are owned by or licensed to Astittva and are protected by copyright, trademark, and other intellectual property laws. This includes:

  • The Astittva name, logo, and brand elements
  • AI algorithms and proprietary technology
  • Birth chart interpretations and astrological content
  • Gemstone descriptions and product information
  • All website and app design elements

B. Your License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may NOT:

  • Reproduce or distribute content without permission
  • Modify, reverse engineer, or create derivative works
  • Use content for commercial purposes
  • Remove copyright or trademark notices

C. User-Generated Content

You retain ownership of content you create (messages, feedback). By submitting content to Astittva, you grant us a royalty-free, perpetual license to use, modify, and distribute it for improving our Service and AI training.

6. Limitation of Liability

A. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

B. No Liability for Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, ASTITTVA SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, special, or punitive damages
  • Loss of data, business, revenue, profits, or opportunities
  • Inaccurate or misleading astrological predictions
  • Reliance on Service content for major life decisions
  • Third-party actions, product quality, or service delays
  • User violations of these Terms

C. Liability Cap

Astittva's total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or ₹500 if no payment was made. This limitation applies to all claims, regardless of legal theory.

D. Your Assumption of Risk

You assume all risk associated with using the Service. You acknowledge that astrological predictions are speculative and should not be used as sole basis for important decisions.

7. Indemnification

You agree to indemnify, defend, and hold harmless Astittva, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your user-generated content
  • Claims based on reliance on our Service for important decisions

8. Service Availability & Modifications

A. Availability

We strive for 99% uptime but do not guarantee continuous, uninterrupted Service. We are not liable for downtime or service interruptions.

B. Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time with or without notice. We are not liable for any such changes or discontinuation.

C. Maintenance

We may perform scheduled maintenance. We will attempt to provide notice, but are not obligated to.

9. Third-Party Content & Links

The Service may contain links to third-party websites and services operated by external parties. We are not responsible for:

  • Accuracy or availability of third-party content
  • Third-party privacy practices or terms
  • Claims arising from third-party services
  • Product quality or services from third parties

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, specifically the jurisdiction where Astittva is registered, without regard to conflict of law principles.

B. Dispute Resolution

Before litigation, we encourage good-faith dispute resolution:

  • Step 2: If unresolved after 30 days, parties may pursue mediation
  • Step 3: Disputes not resolved through mediation may be litigated

C. Jurisdiction

You agree to submit to the exclusive jurisdiction of courts in India for any legal proceedings.

D. Class Action Waiver

You agree not to pursue claims against Astittva as part of a class action, class arbitration, or representative action.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
